UFC star Nick Diaz has filed a lawsuit against The Nevada State Athletic Commission due to a temporary suspension they are currently holding against him after he tested positive for marijuana barbituites following his UFC 143 fight with Carlos Condit back in February.
The thrust of Diaz case brought by his lawyer Ross Goodman is that the NSAC should release Diaz from his suspension due to the fact that the commission failed to honor his statutory rights.
The lawsuit states that, “proceedings relating to the order of summary suspension must be instituted and determined within 45 days after the date of the [suspension] unless the agency and the licensee mutually agree in writing to a longer period.”
Since that has not happened Goodman argues that NSAC has essentially put Diaz in a position where his license has, “been suspended indefinitely.”
The lawsuit also seeks to bring an end to any future punishment for the failed drugs test due to the fac that as a result of their actions (or lack thereof), NSAC, “has lost statutory jurisdiction to proceed with the complaint.”

“On February 7th, 2012, the UFC’s President publicly announced that Mr. Condit agreed to an immediate rematch against me. It is my understanding that the winner of that rematch will be offered a contest against Georges St-Pierre, the current UFC welterweight champion,” writes Diaz.
“The summary suspension against me, made without any consideration of the merits of the Complaint, is the only reason I am aware of that a rematch against Mr Condit has not been scheduled. If the summary suspension is set aside, I would be prepared to compete against Mr. Condit or against any other opponent deemed suitable immediately.”
Diaz’s motion is set to be heard on May 14th and will certainly be a date to mark on your calendar as if Goodman is successful it could be the day that the UFC can welcome back one of it’s most notable stars back into the fold far sooner than anyone would have anticipated.
